    Title: 「司法院之未來風雲再起？——談司法院之定位及司法院正、副院長、大法官提名資格問題」

    Abstract: "本文係就半世紀多以來之司法院大法官會議解釋與基本權保障間之關係,進行整理與分析。在探討層次安排上,係以學理上所普遍採用的基本權侵害之合憲性檢驗步驟作為架構。首先,在基本權保護領域之界定與基本權系譜之擴展上,歴來大法官解釋以就我國憲法第二章之第七至第十八條與第二十一、二十四條等基本權利之個別規定,透過憲法之方式確定其保障範圍;並透過憲法第二十二條之規定,承認該條所保障之人格權,包括姓名權、商標權以及性行為自由。其次,在基本權侵害概念的界定上,除釋字第一五五及二四三號解釋之外,大法官解釋多採取較為寬鬆之立場。再者,於憲法之正當化要件上,關於法律保留原則,其適用範圍已擴展及於有關基本權實現之重要事項,並進一步確認法律明確性原則與授權明確性原則之適用;此外,關於實質法治國原則要件之ㄧ的比例原則,本文亦就大法官對於比例原則之適用予以評價,最後,本文認為釋憲權之行使須符合一定之形式邏輯上以及實質說理上之要求,始能盡其受憲法委託行使闡述憲法意旨及補充憲法規定之職權。"
