Abstract:	證明度係法院事實認定所需心證度之標準，對於其蓋然性高度要求，大陸法系國家及英美法系國家之民事訴訟證據法則有不同之傾向，其運作原理本有所不同。英美證據法上之初步或表見證據（證明）在我國實務或學說上並未作類似發展，而我國實務上對於證明度降低及本證、反證之運用，則與德國及奧地利等國法制類似。如此，對於證明度應為如何之設定，恐應慎重面對此一差異，不可作想當然耳之推想。
