    Abstract: 結婚為身分行為,會產生身分上之法律效果,詳言之,除了發生夫妻之身分關係外,尚發生夫妻間之種種權利義務關係,如夫妻之稱姓、同居之義務、婚姻住所之決定、貞操義務、日常家務之互為代理、扶養義務及夫妻間財產上之權利義務關係,對婚姻當事人影響甚大。因此,多數國家一方面承認結婚自由原則,使男女雙方當事人得基於自由之意思而結婚,但另一方面又課予結婚之當事人必須履行某特定之形式要件,以昭慎重。又,結婚不僅影響到當事人,同時亦影響當事人以外之第三人,因此,多數國家對婚姻之形式要件,或採申報婚主義(日民法七三九),或兼採登記婚與儀式婚主義(德民法一三一至一三一二),其目的均在公示夫妻之身分關係,以確保第三人之利益。
