    Abstract: 就檔案的管理運用而言，牽涉到各種的法律問題，但是其中最重要的，則是檔案是否能夠開放應用的問題，這不但牽涉到檔案機關的權責，也與民眾的隱私與個人權利攸關，例如在國家取得由非公務員所創作的著作時，誰有權加以開放利用方面，往往是爭議最大的問題。由於國家檔案亦可能受著作權法之保護，而著作權法已經就著作的公開有所規定，並就公務員與非公務員著作，以及職務上創作與非職務上創作有詳細的規範，對於何人有公開與利用之權亦已完備，故本文特別從著作權法的觀點，對檔案的公開與運用問題加以探討。
