| Abstract: | 為了解動物地位在我國民事司法實務見解之發展情形，本文先由社會、倫理、法律等方面切入探討動物權之演進。社會及倫理方面，早期在人類中心主義的思想下，動物被視為物，且是毫無感知的「機器」。隨後受到生命中心主義及動物倫理學派思想家的影響，自20世紀末起，「動物權」思想開始蓬勃發展，逐步發展出：「動物福利」、「動物福祉」、「動物權利」等多元之意涵，動物跳脫傳統被視為「物」之巢臼，地位大幅提升，人類與動物的關係開始發生變革，動物變為「寵物」，更進一步成為「家人」。在法律方面，受到這一股動物權思想影響，世界各國開始積極透過法制推動與動物權相關之政策，採取之立法方式包括將動物權入憲、提升動物在法律中之地位或制定與動物權相關之專法。本文選取侵權行為損害賠償事件，進一步分析動物法律地位在美國及德國民事司法實務之發展情形，提供我國參考。
觀察動物權思想在我國之發展情形，我國雖有立法者曾提議制定憲法增修條文將動物權入憲，但尚未取得朝野共識；民法典方面迄今亦未見有相關修法之討論。然而，在我國民事司法實務方面，根據本文之統計分析，自動物保護法民國87年公布施行之後，與侵害動物或寵物相關之侵權行為損害賠償事件逐漸增加，而法院就飼主可請求財產上損害賠償之必要支出費用及請求之金額逐步放寬。多數法院見解認為賠償之範圍除被害動物或寵物之市價外，並應包含喪葬費用亦即火化費用，且陸續出現可請求非財產上損害賠償之判決，可看出動物權思想明顯地逐步影響我國司法實務判決之見解。
To understand the development of animal status in my country`s civil judicial practice, this article first discussed the evolution of animal rights from three aspects: society, ethics, and law. In terms of social and ethics, in the early days of anthropocentrism, animals were regarded as objects, and they were “machines” without perception. Later, under the influence of thinkers from the life-centrism and animal ethics school, a trend of animal rights has emerged since the end of the 20th century, and began to develop "animal welfare" and "animal rights." The status of animals has been greatly improved. Animals become "pets" and further become "family". In terms of law, many countries have begun to actively promote animal rights-related policies through the legal system. This article selected tort damage compensation incidents to analyze the development of animal legal status in the United States and Germany`s civil judicial practice, hoping to provide reference.
Although some legislators in my country have proposed to enact constitutional amendments to include animal rights in the constitution, the government and the public have not yet reached a consensus. The status of animals has also not been discussed in the civil code of our country. By contrast, according to the statistical analysis of this article, after the Animal Protection Law came into effect in 1987, damages for torts related to animal or pet have gradually increased, and the compensation fee allowed by the court are relaxed. In addition, most courts believe that compensation for death caused by infringement should not only include the market price of the animal or pet, but also include funeral expenses. Even a few courts believe that non-property damages should be allowed. It can be seen that the animal rights ideology has obviously gradually affected the judicial decisions in our country. |
