Title:	論「武林群俠傳」遊戲著作之著作權歸屬問題—從最高法院110年度台上字第1167號民事判決談起

Abstract:	智冠科技股份有限公司主張其為「武林群俠傳」電腦遊戲之著作財產權人，並控告河洛遊戲有限公司發行之「俠客風雲傳」電腦遊戲侵害其著作財產權。一審法院於2019年判侵權成立。二審法院於2020年維持侵權成立。不過，在2022年，最高法院推翻前審的決定，並認為「武林群俠傳」電腦遊戲之著作財產權歸屬不明。本文意在分析最高法院的意見，包括：（1）河洛遊戲負責人徐昌隆與智冠科技間就「武林群俠傳」開發時之關係非屬僱佣關係；（2）雙方的委託製作遊戲合約的版權轉讓規定並非代表著作財產權之轉讓。此外，本文欲藉由本案討論委託製作電腦遊戲時著作權歸屬約定之問題。最後，本文闡述當事人雙方是否存在默示授權之關係。
