| Abstract: | 近年來隨著醫療科技之發展與人權意識之興起，人們逐漸了解到醫學救治之有限性，為避免患者因維生醫療而承受過多無端之痛苦，社會開始發展出所謂醫療自主權、死亡自決權等概念。除民間團體紛紛林立並發起相關運動外，許多國家亦陸續放寬立法，將安樂死予以合法化，而我國對於安樂死議題之呼聲與討論也並不例外，部分政黨更曾多次提出尊嚴善終法草案，希望透過立法可早日建立我國安樂死制度。然安樂死目前於我國法律上仍將被視為自殺行為，又故意自殺於保險中屬於道德危險，為法定不保事項，故在未來我國安樂死可能合法化之背景下，實有必要加以討論安樂死行為所涉及之保險相關問題。
本文以風險管理與保險之角度為出發，探討安樂死合法化後，該行為與風險之可保性，以及其對於保險制度上之影響及規劃。透過本研究得出，安樂死並未違反我國憲法保障基本權，且在保留刑法加工自殺罪之情況下，建議以立法形式加以規範。又安樂死及其風險損失乃具有可保性，其並未違反保險最大誠信原則，亦不違反社會中之公序良俗，因此保險相關法規及制度應隨著安樂死之合法化進行適當之調整，政府及相關自律組織於實務上亦應扮演引導之角色，協助業界面臨安樂死理賠申請時之應對進退，避免保險爭議之產生，以達到制度整合之成效。
In recent years, with the development of medical technology and increasing awareness of human rights, people have gradually recognized the limitations of life-sustaining medical treatment. To avoid patients suffering undue pain, concepts such as medical autonomy and the right to die have been developed. In addition to the initiative by human rights groups, many countries have gradually extended their legislation to legalize euthanasia. Taiwan is no exception, with some political parties repeatedly proposing the "End of Life with Dignity Act" to establish a euthanasia system in Taiwan through legislation. However, euthanasia is considered suicide under the law in Taiwan, and these intentional acts are deemed a moral hazard, which is not covered by insurance. Therefore, under the circumstances that euthanasia may be legalized in the future, it is necessary to discuss issues of insurance involved in euthanasia.
This study discusses the insurability of euthanasia and the impact of legalization on the insurance system from the perspective of risk management and insurance. Based on this research, it is concluded that euthanasia does not violate the fundamental rights protected by the Constitution of Taiwan, and it is recommended to regulate it through legislation while retaining the punishment for entrusted murder and assisted suicide in the Criminal Code. Euthanasia and its risks are insurable. It does not violate the principle of utmost good faith in insurance and public order or good morals. As a consequence, insurance regulations and systems should be appropriately adjusted with the legalization of euthanasia, and the government and self-regulation organizations should play a guiding role in assisting the industry in handling euthanasia insurance claims to avoid disputes and promote system integration. |
