| Abstract: | 臺灣於2009年頒布「人口販運防制法」，打擊人口販運已10逾年，美國國務院年度的人口販運報告（Trafficking in Persons Report, TIP report）連續13年將臺灣評等為第一級(Tier1)國家，但臺灣仍被貼上人口販運「輸入國」、「轉運國」及「輸出國」等標籤。近年來隨著交通運輸科技之進步，以及全球化的密集互動，使得全球移動人口增加，也使人口販運問題日益受到重視，身處於世界一員的臺灣也在這股浪潮中。本研究之目的為藉由蒐集相關次級文獻，比較傳統人口販運態樣與新型態人口販運態樣，以瞭解現行人口販運的犯罪態樣及促成人口販運犯罪發生的原因；經由蒐集、統整過往案例文獻，瞭解臺灣人口販運存在的因素與對臺灣社會的影響，並從防制人口販運四大面向之政策著手，通過各政府部門協助，訂定相關措施、執行專案及加強被害人人別辨識與保障，以補足實務上可預見之狀況。綜合文獻探討得出在臺灣外籍移工易遭販運原因、移工權利未受保障、查緝單位對於人別辨識有待加強教育，以及新型態犯罪手法阻礙司法調查，並提出推動立法保障外籍移工(遠洋外籍漁工)權益、修正法條對加害人加重刑罰，以及精進執法人員教育訓練等政策建議。
Taiwan promulgated the "Human Trafficking Prevention Act" in 2009. It has been more than 10 years to combat human trafficking. The US State Department`s annual human trafficking report (Trafficking in Persons Report, TIP report) rated Taiwan as Tier 1 (Tier 1) for 13 years. But Taiwan is still labeled as an "importing country", "transit country" and "exporting country" for human trafficking. In recent years, with the advancement of transportation technology and the intensive interaction of globalization, the global mobile population has increased, and the issue of human trafficking has also attracted increasing attention. Taiwan, which is a member of the world, is also in this wave. The purpose of this study is to compare the traditional forms of human trafficking and the new forms of human trafficking by collecting relevant secondary literature, so as to understand the current criminal forms of human trafficking and the reasons that contribute to the occurrence of human trafficking crimes; through collection and statistics integrating previous case documents, understanding the factors of human trafficking in Taiwan and the impact on Taiwan society. Starting from the four aspects of policies to prevent human trafficking, with the assistance of various government departments, formulate relevant measures, implement special projects and strengthen the victim`s personality identification and protection to make up for practically foreseeable situations.
Comprehensive literature review, the reasons why foreign workers are vulnerable to trafficking in Taiwan, the rights of foreign workers are not guaranteed, the investigation units need to strengthen education on identification, and the new criminal methods hinder judicial investigation. Propose to promote legislation to protect foreign workers (Ocean-sea foreign fisherman) rights and interests, amending the law to increase the penalty for offenders, improving the education of law enforcement officers and other policy recommendations. |
