| Abstract: | 目前東南亞擁有更龐大商機的經貿市場，東南亞的發展策略備受全球關注，其中當然也包括東南亞專利法的發展策略與狀態，企業商品於進出口時難免會涉及專利法中之發明、製造、使用、販賣等行為，這是專利法必須被企業重視的原因。本文主要是探討馬來西亞與台灣之專利制度的差異，近年來台灣政府積極研討東南亞的智財法制實施、申請實務及執法等智財保護議題進行交流，同時馬來西亞在東南亞是一個擁有非常多外商投資的國家，因此選擇馬來西亞作為比較對象。本文對馬來西亞與台灣的專利法之比較，著重於實際實施規範的比較，以及國內外企業、專家學者、判例著重的規範做比較並分析其原因，爰此，本文不著墨於法條條文背後的法理形成與含義之探討。本文發現馬來西亞和台灣的專利法都致力於盡可能符合國際專利條約和公約的要求，以確保專利制度的國際一致性和保護，但由於國家民情與文化因素，各國的專利法制皆有其自身之特色。本文於比較研究後，發現馬來西亞專利法距離上一次修法已是16年前，說明這16年間馬來西亞專利制度是停滯的，故馬來西亞應對國際動態更加關注，且隨著科技發展迭代而修改專利法，以免在多國的競爭中失去競爭力；台灣專利法之條文規定相對不直觀，對於母語非中文或不了解台灣體系之申請人，若欲閱讀或查閱台灣專利法規造成諸多不便，雖台灣另外設立專利審查基準，但申請人可能無法在短時間內完全了解台灣專利制度。本文提供了兩國專利法中的優缺點，有助於政策制定者、企業家和研究人員更快地理解專利法制度如何影響創新、經濟和國際合作。
Currently, Southeast Asia possesses a vast economic and trade market with significant opportunities. The development strategies of Southeast Asia are closely observed globally, which includes the development strategies and status of patent laws in Southeast Asia. When companies engage in the import and export of goods, they inevitably encounter activities related to patents, such as invention, manufacturing, using, and offering for sale. This is why patent laws are important to businesses. This article primarily explores the differences between the patent systems in Malaysia and Taiwan. Recently, the Taiwanese government has actively engaged in discussions regarding intellectual property legislation, application practices, and enforcement issues in Southeast Asia. Simultaneously, Malaysia is a country in Southeast Asia with a significant influx of foreign investment, making it a suitable comparative subject. This article compares the practical implementation standards between Malaysia and Taiwan's patent laws, analyzing the reasons behind the differences emphasized by enterprises, experts, scholars, and legal precedents. Therefore, this article does not delve into the discussion of the legal principles and meanings behind the articles of the laws. This article finds that both Malaysia and Taiwan's patent laws are committed to aligning their patent systems with the requirements of international patent treaties and conventions. However, due to national cultural factors, each country's patent system has its unique characteristics. This research discovers that Malaysia's patent law has not been amended for 16 years, indicating stagnation in Malaysia's patent system during this period. Consequently, Malaysia should pay attention to international developments and make sure its patent laws in line with international treaties to remain competitive. Taiwan's patent law articles are relatively less straightforward, which can create inconvenience for applicants who are not native Chinese speakers or are unfamiliar with the Taiwanese system. Although Taiwan has established separate patent regulation guidelines, applicants may not fully comprehend Taiwan's patent system in a short period. This article provides insights into the strengths and weaknesses of the patent laws in both countries, aiding policymakers, entrepreneurs, and researchers in gaining a quicker understanding of how patent law systems impact innovation, the economy, and international cooperation. |
