    Abstract: 歐洲民法法典化運動正方興未艾，如火如荼開展著，在盟歐官方機構推波助瀾下，歐洲學界在二〇〇九年二月推出學術版之共同參考架構草案（DCFR），對整合歐洲契約法與現行法之行動，引發強烈討論與迴響。此草案在有關債務不履行責任之部分，本著實用性之觀點，重新統整與融合歐陸法系與普通法系對於債務不履行之救濟方式，其中具體之規定有向歐陸法系靠攏者，有向普通法系趨近者，有取擷國際法者，更有截各法系之長，補各法系之短，而自成一章者，在在顯示出草擬者企圖建構一個歐洲化與國際化之模範規則。縱然此草案僅是歐洲學界之研究成果，但從比較法角度觀之，卻深具啟示作用，且歐盟官方機構在建置共同參考架構（CFR）工作上，是否仿效此草案，更是值得續行關注。
