    Abstract: 本文以臺灣高等法院臺中分院 111 年度上易字第 384 號刑事判決為對象，關於背信罪成立時客觀上必須具備的「他人之事務」要件，就法院所採的判斷標準，從理論的觀點進行評釋與探討。在介紹本件的事實關係與歷審法院的判斷後，也透過對於相關案件的概觀掌握本件於實務的脈絡。透過本文的考察可知本件判決對於「他人之事務」的判斷標準，採取的是目前實務上常見的主流判斷標準（本文稱為「法律關係性質基準說」）；這樣的標準固然可能具有避免罰及純粹民事上債務不履行行為的用心，但是在理論上欠缺明確的根據，在背信罪成立的具體範圍上也未必妥當。然而對於這樣的實務理論上的問題，目前我國學說能夠提供的指引相對有限，因此本文也嘗試探討解釋論上可能的標準，而提出以規範上的事務歸屬為標準的見解（本文稱為「規範的事務歸屬基準說」），並透過類型化的方式，嘗試明確化背信罪的「他人之事務」的可能範圍，希望能藉此對於此一實務上的重要問題提供理論上可能的指引。
