Title:	論發明之進步性技術特徵的界定──從智慧財產法院106年度行專訴字第27號行政判決談起

Abstract:	進步性之判斷涉及引證案的理解與數件引證案的資訊能否組合的問題，乃屬技術性質的主觀認定。本文以智慧財產法院 106 年度行專訴字第 27 號行政判決為例，介紹該案所請發明未能滿足進步性的主因，並檢視相關請求項的問題。該案申請人的再審聲請顯示其對系爭發明之重視，但其未能取得專利之原因值得討論，而有實務上意義。以下，本文先介紹本案所涉及的專利申請案，包括其發明內容與申請歷史。再者，本文分析本案智財法院判決。最後，本文提出該案申請人最初可如何修正請求項以克服進步性核駁。
