    Abstract: 本文將分析全球供應鏈中兩家重要的半導體公司——英偉達(NVIDIA)和台積電(TSMC),以及這兩家公司如何因應行業內新近擴大的美國出口管制進行業務調整。美國的出口管制具有域外效力,這意味著即使公司總部不在美國,也必須遵守華盛頓的法律法規。隨著中美經濟關係的不斷惡化,兩國政策制定的動機愈加明顯,但這些動機與台灣企業尋求新市場、廉價勞動力和利潤最大化的目標並不一致。本文將說明,現有文獻並未完全描述這些私人企業所採取的一系列應對行動,特別是台積電作為全球領先的晶圓代工 廠如何在此情況下進行調整。相反,本文提出一個新的理論框架,強調企業與監管機構之間的政府關係是主要因素,其次是供應鏈動態。本文的目的並不是確定出口管制是否有效,但如果企業對這些法規缺乏認同,可能會降低其效力,甚至可能使問題更加複雜。台積電和其他台灣企業在全球市場中的靈活應對和戰略調整,是我們需要關注的重要議題。
    This paper will analyze two semiconductor firms at distinct parts of the global supply chain, NVIDIA, and TSMC, and how each of them has adjusted their operations due to newly expanding export controls within the sector. American export controls are extraterritorially applied, meaning that even non-U.S. based firms are subject to Washington D.C’s laws and regulations. As U.S.-China economic relations continue to deteriorate, the incentives for national policies in both countries are clear, but those incentives are misaligned with those of private capital that seeks new markets, cheap labor, and maximized profits. This paper will show that existing literature over sanctions, the most prominent tool of economic statecraft, do not fully describe the range of actions that these private firms undertake. Instead, the paper will put forward a new theoretical framework in which government relations between the firm and regulators are the primary factor, followed by supply chain dynamics. While the goal of this paper is not to determine whether export controls are an effective tool or not, a lack of corporate buy-in to these regulations will lower their efficacy and potentially even worse the situation they seek to resolve.
