    Title: 虛擬社會中的道德法庭:網路公審的產生、運作與影響
    The Moral Court in the Virtual Society: The Emergence, Operation, and Effect of Cyber Public Trials

    Abstract: 現實社會中與公平正義相關的議題經常在虛擬社會中被討論,進而產生網路公審的現象。為此,本研究比較公審在虛擬社會與現實社會間的差異,並探討發起網路公審為何成為現今社會大眾爭取公平正義偏好使用的手段、網路公審的運作、各類角色的行動與互動、與網路公審對現實社會帶來的影響。
    本研究以Facebook、Instagram、Dcard、PTT四大網路社群平台為研究場域,透過深度訪談法、參與觀察法與問卷調查法進行資料蒐集。研究者以網路公審中發起者、參與者、受審者三個角色作為深度訪談的目標群體,透過21位受訪者,瞭解各角色在參與網路公審時的態度以及對於其他角色的看法,並針對四大社群平台之公審貼文及留言進行參與觀察。此外,研究者也在四大社群平台發放網路調查問卷(共計回收77份),以蒐集網路使用者對於網路公審的看法。
    網路使用者對虛擬法庭的運作存在理想型劇本的想像,即是公審會針對事件行為本身進行討論。若參與者皆能遵照這樣的劇本期待,網路公審有機會成為虛擬社會對不同事件、議題進行公共討論的理想空間。但實際上往往會有發起者為了一己之私,導致展演出現「逆風」的插曲。此外,當針對行為進行譴責已無法滿足留言者心中的正義時,會出現「人肉搜索」的情形,以正義為名包裝自身的惡意。儘管虛擬法庭中公審的結果常能滿足現實法庭判決所無法達成的道德正義,但是無法提供受害者實質上的幫助,因此對其並不算真正取得所尋求的公平正義。個人情緒及身分在網際網路的不可辨識性,經常導致網路公審衍生為網路霸凌,甚至影響受審者在現實社會的生活與身心狀態。但網路公審也可引發公眾重新檢視社會規範與價值,進而產生正面的影響。
    本研究應用劇場論、社會心理學理論與傳播學理論,對網路公審的產生、發展過程、各類行動者的行為與互動、與對現實社會的影響提供重要的實證解釋。其研究結果不僅建立相關理論的跨域對話,也具有政策與實務上的參考價值。
    Issues related to fairness and justice in real society are often discussed in virtual communities, leading to the phenomenon of cyber public trials. This study distinguishes the features of cyber public trials from those in real society, examines why initiating public trials have become a preferred method for the public to pursue fairness and justice today, the operation of cyber public trials, the actions of and interactions among participants in various roles, and the impacts of cyber public trials on real society.
    The study employed Facebook, Instagram, Dcard, and PTT as field sites. Data were collected through in-depth interviews, participant observation, and an online survey. The study targeted three roles in cyber public trials for recruiting informants: initiator, participant, and the person on trial, and interviews were conducted with 21 informants. Participant observation of public trials’ posts and comments was performed on the four online social platforms. The study also conducted an online survey on these four platforms (77 valid questionnaires received) to gather the Internet users’ opinions on cyber public trials.
    There is an ideal type of script held by Internet users for how the virtual courtroom should operate, that is the discussion would focus on the incident or behavior in question. If participants in the virtual courtroom follow this script, cyber public trials could potentially become the ideal site for public discussion of various events and issues. However, in practice, the initiator may pursue personal interests, causing a backlash in the performance. Furthermore, when condemning behavior fails to satisfy the commentators’ sense of justice, “doxing” would often take place in the name of justice to disguise personal malice. Although the outcomes of public trials in the virtual courtroom often achieve moral justice that the real courtroom may not grant, cyber public trials do not provide tangible assistance to victims, thus failing to deliver the genuine fairness and justice. The ambiguity in personal emotions and identity on the Internet often foster cyberbullying in cyber public trials, affecting the life as well as the physical and psychological well-being of the person on trial. Cyber public trials may also enable the public to reexamine social norms and values and generate positive impacts.
    By applying dramaturgical theory, social psychological theories, and media theories, this study provides sound empirical explanations of cyber public trials’ emergence and developmental process, the behavior of and interactions among various actors therein, and the impacts of cyber public trials in real society. The results not only establish cross-disciplinary theoretical dialogues but also carry valuable practical and policy implications.
