    Title: 臺北市違章建築興建與存續的決定因素
    Contributing Factors to the Prevalence of Unauthorized Building Works in Taipei

    Abstract: 違章建築常被稱為都市之瘤。違章建築充斥在臺灣各個都市,甚至引起災害、奪走性命。儘管政府多次宣示要解決這個所謂的不文明問題,卻總是徒勞無功。違章建築普遍存在開發中國家,主要原因為政府失靈、無法提供足夠住宅,人口快速且大量移入都市,或是相關建築法令缺乏等。其實違章建築也存在不少已開發國家,例如義大利、希臘、西班牙、香港等。相對於開發中國家,這些已開發國家法令已經建立,政府也正常運行,而且也已經過了都市快速擴張的階段。雖然已開發國家都市也存在違章建築,但是卻很少研究探討這個現象,更遑論提供實證發現。然而違章建築的普遍存在,不僅其成因值得思考,它的存在也凸顯土地利用和都市發展出現問題。本研究視興建違建,為屋主考量產生的效益和成本之後,所做的理性決策。因此,違建興建行為可以藉由相關經濟、社會及制度因素解釋。根據這樣的思維,本研究將使用類別資料迴歸 (logit regression) 以及追蹤資料迴歸 (panel data regression),分析臺北市都市發展局所提供之1992-2013年共252,454 筆違章建築個體資料,回答以下兩個研究問題:(一)、哪些原因造成各里之間違章建築數量的不同?(二)、為什麼有些違章建築短時間內被處理完畢,而有些卻是長期存在?實證結果可以幫助我們了解決定興建違章建築的重要社會、經濟因素,據此提出違章建築相關政策。
    Unauthorised building works or even illegal human settlements are commonplace in many developing countries. Cities in these countries are widely suffering from the lax enforcement of law, lack of social housing and mass migration from countryside. In contrast, UBWs are rarely observed in developed countries. Cities in developed countries are generally well governed where land use regulations are effectively imposed. However, UBWs are not uncommon in certain cities in Hong Kong, Italy, Greece and Taiwan. The prevalence of UBWs highlights the mismanagement of land uses in these cities. Moreover, behind the UBWs phenomenon lies the problems of soaring housing price, shortage of public house and bad urban governance. UBWs in developed countries therefore deserves more academic attention. This research considers construction of UBWs a rational decision in which associated benefits and costs are explicitly calculated. Owners of a house with UBWs enjoy expanded interior spaces, but need to pay additional house taxes and endure the risk of UBWs being detected and demolished. We have obtained the data of 252,454 UBWs reported to the Taipei City Government between 1992 and 2013. We take the advantage of the large number of reported individual UBWs to run the logit regression and panel data regression, respectively. With the supporting empirical evidence, we are able to identify the underlying factors that determine if a UBWs is to be constructed and if a UBWs is to be torn down soon after it was reported or to remain in existence for years.
