    Abstract: 專利侵權之損害賠償計算向來是各國專利法所關注的重要議題。因專利權所支配者為解決技術問題之無形構想,有別於傳統之物權,再加之專利法鼓勵創新的立法意旨,如何貫徹實踐國際專利法於損害賠償所強調之「充分補償」法理,實為我國司法實務長期以來所面臨之任務與責任。本專書寫作之主要目的有四;首先,以「充分補償」法理為中心,為我國專利法第97條之解釋適用,特別是由法律經濟分析的角度,擇定適切的理論基礎;第二、基於前所擇定之理論基礎,全面檢討與反省我國專利法第97條之相關司法實務,重新建構各損害賠償計算模式之新詮釋;第三、本專書亦特別關注新科技發展對於專利損害賠償法制的衝擊與因應,此點為各國所持續關注,我國較少有文獻提及;最後,藉由專利損害賠償法制的研究,本專書將延伸討論損害賠償於專利訴訟實務的程序議題,同時檢討我國專利損害賠償相關之舉證制度。
    Calculation of patent damages under patent law has been among the most concerning issues in the various jurisdictions. Distinguished from the subject matter governed by traditional property law, what patent rights are designed to dominate is the tangible idea for solution of specific technical problem. In addition, patent law has always promoted its unique jurisprudence of innovation. As a result, it is the significant responsibility for our judicial practice to follow the jurisprudence of adequate compensation addressed by international patent law for interpretation of related provisions under Taiwan Patent Act. The main purpose of this book may be observed in the four aspects. Firstly, this book will seek a theoretical basis to justify the jurisprudence of adequate compensation worshipped by patent law, including the economic analysis of law. Moreover, based upon the aforesaid theoretical basis, this book will reflect the traditional interpretation of Article 97 of Taiwan Patent Act in the judicial cases, and further reconstruct the framework of patent damages, as well as the reasonable interpretation of the related provisions. Thirdly, this book is also concerned about the challenge of emerging technologies upon patent damages and the adjustment of patent law to respond to the aforesaid challenge. Finally, in order to consummate the system for patent damages, this book will extend its study base to cover the procedural issues connected with patent damages. The issue of collection or discovery of evidence in the patent litigation will be an essential focus.
