Abstract:	本計畫主要之研究目的在於檢討與再建構我國商標侵權損害賠償法之體系與合理之解釋適用，適以美國聯邦商標法第1117條及其判例法為比較研究基礎，研究成果期待可形成相關議題未來學術延伸研究之基礎，更可作為司法判決實務解釋適用之參考。
