    Abstract: 近年來,數位平台(digital platform)所帶來的新經營模式,已經大幅改變人們的經濟生活與產業經營方式。由於電腦運算效能越來越強,個人數據量大幅增加,業者在此基礎上開發預測使用者行為之蓋然性規則,透過目前普及的寬頻行動裝置提供即時性個人化服務,使得數位平台藉由優越的即時媒合能力,成為傳統中間商的強勁競爭對手,並且開創共享經濟新交易模式,打開仲介平台的新天地。然而廣告型平台的出現、平台為競爭目的所匯集的大量使用者數據,以及雙邊市場交叉網路效應等特性,都不是競爭法既有分析工具所足以肆應,且數位平台身處的網路產業乃是以創新帶動的動態市場,在數位技術、人工智慧與經營模式不斷翻新之下,對於當代競爭法形成相當大的挑戰,亟待吾人全力加以研究,開發新的競爭分析工具,並且引入最新產業與科技知識,方能跟上當代產業的最新轉變。本計畫將以二年時間,區分三個執行階段,認清使用者數據與雙邊平台之經濟性格,重塑原本市場力量之分析架構,並且針對原有分析工具之痛點,研發全新評估方式與分析步驟,最後反省檢討新出現之交易行為有無競爭法無法因應之疑難困境,以面對網路數位平台全面入侵吾人生活的人類新時代。
    During recent years, digital platforms have changed people’s economic life and the way they do their business dramatically. Due to the enhanced efficacy of electronic computation, increase of personal data, predictive rules developed bases on the two, and widespread broadband mobile devices, digital platforms can now provide real-time personalized service, become strong contenders against traditional intermediaries, and even create a new industry―the sharing economy. Nonetheless, advertising-type platforms, big data from users, and the economic features of digital platforms such as two-sided platform and cross-side network effect, all bring unprecedented difficulties to competition law. It is further exacerbated by the nature of internet―a dynamic market driven by innovation. In light of those challenges, this project is purported to expend two years to clarify the connections of user’s data and two-sided platforms with their impact on market competition, and remodel the framework of market power assessment and other analytical tools of the completion law to response accordingly to new business models of digital platforms. It will further review novel types of transactional behaviors on digital platforms to check their compatibility with the present regime of competition law enforcement to cope with the omnipresence of digital platforms in the coming epoch.
