    Abstract: 在《一九八二年聯合國海洋法公約》通過已逾三十年,生效已逾二十年的今日,國際海洋法制已有長足發展,在公約建立之架構下,透過國際合作以及課予國家制訂國內法之義務,國際海洋法制正在逐漸發展中,而且益發蓬勃。為檢視公約之效力,應進一步探討公約與各國國內法的關係,因為國內法乃是落實公約目的之途徑之一。在這樣的背景下,本研究計畫以《一九八二年聯合國海洋法公約》為核心,探討我國國內海洋法政如何看待此一國際規範,此一國際規範又如何在我國國內法中被轉換或吸收,本研究計畫從政策制定層面、海洋立法層面、乃至於法院判決層面,分別檢視公約在我國適用的狀態。為求論述周延,考量到我國社會與法治對於國際法之態度實受美國法影響深遠,加以美國亦非《一九八二年聯合國海洋法公約》締約國,亦以美國法政作為比較之基礎,充實論述。初步可以發現我國雖有相關立法,但政策制定仍待進一步發展,如此突顯我國法院判決常見論述不明確,對於公約所建立之海域分區架構亦不明瞭的窘境。而美國海洋法政發展雖較進步,但法院對於公約之態度,亦多莫衷一是。或許是我國與美國同為非公約締約國,所共同面對的宿命。
    Since the adoption of the United Nations Convention on the Law of the Sea (LOS Convention) more than three decades ago and its entering-into-force nearly two decades ago, the international law of the sea regime has developed through international cooperation and domestic laws. To assess the LOS Convention’s efficacy, it is necessary to examine the relations between the LOS Convention and different States’ domestic laws. This is especially as the LOS Convention can be applied via domestic laws. This LOS Convention-focused research project examines how Taiwan’s domestic marine policy responses to this Convention. Also examined is how the Convention has been transformed and incorporated into Taiwan’s domestic legal system. Through policy-making, marine legislation, and dispute settlement analyses, the project evaluates the LOS Convention’s status. For a greater grasp of the aforesaid analyses, the United States’ marine policy and legal developments are used as comparative foundations to Taiwan’s. This is given the facts that Taiwan’s society and legal system have certain U.S. influences and that the U.S. is also not a contracting party to the Convention. This project’s preliminary research has shown that though Taiwan’s legal framework has adopted various marine affairs-related regulations, Taiwan’s policy making is still in its mere infancy. Also researched are, in marine affairs-related cases, the rising concerns of Taiwanese court rulings that demonstrate disrespect to and misinterpretations of the LOS Convention. Similarly, even with the United States’ well-developed marine policies and regulations, U.S. court rulings often fail to have concrete attitudes toward the Convention. Perhaps as both Taiwan and the U.S. are not contracting parties to the Convention, the aforesaid court rulings could indicate that both Taiwan and the U.S. might face the fates of not respect the LOS Convention.
