    Title: 老人保護財務剝削案例之跨專業合作經驗初探

    Abstract: 我國邁入高齡社會後,老人保護通報件數逐年攀升,老年人所遭遇的受虐樣態也日益複雜。其中,「財務剝削」常伴隨身體虐待、心理虐待及疏忽等,同時涉及資產管理、法律及家庭動力等多重面向,對第一線老人保護工作者而言在評估與處遇時充滿挑戰。本研究以老人保護社工在老人財務剝削案件之處遇經驗,探究老人保護社工在跨專業合作上的具體經驗與策略,期望為我國老人保護實務提供參考。
    本研究採質性研究方法,透過立意取樣邀請九位負責老人保護之社工進行深度訪談,佐以相關文獻資料進行分析。本研究之研究結果如下:
    一、老年人若身陷財務剝削情況,多伴隨親情依附、自我認知不足或身心功能退化等因素,使其難以及時擺脫不當財務控制。
    二、財務剝削經常與其他虐待(例如疏忽、精神虐待)同時發生,形成「多重虐待」型態,對老人生活安全與照顧資源造成嚴重衝擊。
    三、第一線社工在因應財務剝削時,面臨評估工具有限與法律、金融專業知識不足等挑戰,亦需要和銀行、警方與醫療單位保持合作。
    四、跨專業合作可透過明確分工、資訊共享與尊重各單位專業角色,並在長期互動與會議協調中建立信任與共識,使保護服務能更有效率地進行。
    藉由以上研究結果,提出以下研究建議:
    一、加強財務剝削之評估與防治機制:政府應發展適切之評估工具與定義,並鼓勵執行老人保護相關單位加強針對財務議題之篩檢與追蹤。
    二、強化跨專業網絡與統整平台:包括銀行、警政、司法與醫療單位的資訊共享機制與定期會議制度,能及早辨識高風險案例並防範財務剝削之發生。
    三、增補法律與行政配套措施:透過修訂相關法令或制訂指引,使涉財務侵佔相對人有明確處罰與救濟途徑;亦需協助個案進行財務信託、以房養老、意定監護等規劃。
    四、培力第一線社工的財務與法律知能:持續辦理在職進修、與法律或金融專業者合辦培訓,提高社工在偵測財務剝削與連結跨專業資源的自信與能力。
    五、強化財務剝削通報機制與統計資料:建議增加財務剝削案件的情境分類(如資產移轉、擅自提款、繼承爭議等)及兩造關係(如子女、照顧者、朋友等),並建置跨年度追蹤指標,以補統計缺口並提供政策修正依據。
    本研究期盼透過上述結論與建議,協助老人保護實務體系更加完善面對財務剝削合併多重虐待之挑戰,進一步確保高齡者能獲得及時且全方位的安全保護與生活照顧。
    Focusing on “financial exploitation combined with multiple abuses” within Taiwan’s elder protection realm, this study examines frontline social workers’ interdisciplinary collaboration experiences when dealing with the interplay of financial, legal, caregiving, and psychological concerns. Through in-depth qualitative interviews with social workers and supplementary literature analysis, the findings reveal that financial exploitation often involves manipulative relationships rooted in emotional and care dependencies, making such cases difficult to detect and complex to address. Nonetheless, effective interdisciplinary collaboration—engaging judiciary, medical, financial, police, and social welfare units—can significantly enhance promptness and comprehensiveness in elder protection responses.
    Key Findings:
    • Older adults facing financial exploitation often experience emotional dependency, under-recognition of exploitation, or functional decline, hindering their ability to disengage from financial control.
    • Financial exploitation frequently co-occurs with other abuses (e.g., neglect, psychological mistreatment), resulting in “multiple abuses” that severely impact elders’ living safety and care resources.
    • Frontline social workers encounter limited assessment tools and a lack of legal/financial expertise; they also need ongoing collaboration with banks, law enforcement, and medical institutions.
    • Interdisciplinary collaboration proves more effective through clear role definitions, information-sharing, respect for each sector’s expertise, and trust-building via long-term engagements and coordinated meetings.
    Recommendations:
    • Enhance Financial Exploitation Assessment and Prevention Mechanisms: Develop more nuanced evaluation tools and definitions. Encourage elder protection centers and social service agencies to strengthen financial risk screening and monitoring.
    • Reinforce Interdisciplinary Networks and Platforms: Establish consistent information-sharing and regular meeting systems among financial, police, judicial, and healthcare bodies to detect high-risk cases earlier and prevent exploitation.
    • Augment Legal and Administrative Supports: Amend relevant laws or establish protocols for explicit penalties and recourse if care workers or family members engage in financial exploitation. Assist elders in designing financial trusts, reverse mortgages, or guardianships.
    • Empower Frontline Social Workers with Finance and Legal Expertise: Facilitate on-the-job training and cooperative workshops with legal or financial professionals, enhancing confidence and competence in detecting financial exploitation and mobilizing cross-sector resources.
    By presenting the above conclusions and recommendations, this study aims to help improve Taiwan’s elder protection system in addressing the challenges of financial exploitation combined with multiple abuses and ensuring older adults receive timely and holistic safety and care.
