Abstract: | 本文旨在探討漢娜.鄂蘭的政治思想對於當代人權概念的啟發。透過對於當代人權概念幾個主要理論困境的分析,本文發現當代人權概念深植於社會契約論的傳統之中,並主張契約論預設的「個人主義式自由觀」以及「主權政治架構」—也就是鄂蘭所謂「垂直社會契約」架構,是導致當代人權概念無法實現其自身期待的根本原因。本文以鄂蘭「政治本體論」的視角重新詮釋「擁有權利的權利」概念,認為唯有透過恢復「共同世界」作為人言說與行動的重要場所、重拾人作為「政治行動者」的能動性,人權概念賴以建立的「本體論基礎」才有被重建的可能性。據此,本文主張以「愛世界(amor mundi)」作為觀看並與世界互動的根本態度,才是確保當代人權概念得以實踐其自身的重要基礎。 This thesis investigates the theoretical dilemmas surrounding the contemporary concept of human rights and seeks to reconstruct a so-called “ontological foundation” through Hannah Arendt’s notion of “the right to have rights.” It argues that modern human rights discourse is deeply shaped by the tradition of social contract theory, which presupposes an individualistic conception of freedom and a sovereign-centric political framework. These presuppositions result in a conceptual deadlock between what human right claims itself could achieve and what it actually achieves. The thesis contends that Arendt’s idea of “the right to have rights” is not merely a political appeal for stateless individuals but an ontological proposition that underscores the necessity of a “common world” wherein human dignity and freedom are manifested through action and speech. Through revisiting Arendt’s political ontology, this study demonstrates that human rights are only practicable when the conditions for political agency and intersubjective worldliness are restored. Ultimately, the thesis asserts that beyond legal and institutional design, it is the way individuals relate to the world and others—an attitude of “amor mundi”—that enables the meaningful realization of human rights today. |
