    摘要: 原住民族在尋求自治之過程中，無可避免必須先確立「立足之地」，此即建構原住民族居住權利之核心，一個提供原住民族足以發展、實踐民族尊嚴與民族文化、傳統價值之居住所在。因此，本研究希望建構促進原住民族達成自治目的之居住權利之權利概念，有別於一般個人主義下之基本權利，而是一個以民族為核心價值的集體、分享權利。再以此權利概念為根基，設計相關符合原住民族居住權利實踐之制度。若研究目的如預期達成，相信可以提供現行居住於原鄉與都市之原住民族，更完整的居住權利保護，提昇原住民族較為弱勢的的社會經濟地位，同時也有助於我國族群平等之達成。
