    Abstract: 在臺灣地區,物權法定原則已經理論檢討而有松動的傾向,以因應社會、經濟發展的需要。然而在兩岸的民事立法中,法定物權似乎仍未加檢討地呈現方興未艾之勢。法定物權固然有諸多合理的經濟與非經濟方面的價值,如提高資源利用效率、實現分配的公平等,但是也會制造未必能夠內化于交易本身的顯著社會成本,如確認物權狀態的成本,以及因不合特定交易需求而發生的排除、補充與防止法定物權的成本,并會扭曲競爭機制。法定物權與物權法定原則固有區別,惟在國家介入財產權關系方面,實秉承一脈相承的立法政策,故亦應從私法自治的基本理念出發加以檢討,建立妥當的法定物權立法政策。
