Title:	美國法院對於網際網路服務業者著作權輔助侵權重要判例之研究

Abstract:	本研究所要討論的問題即與網際網路的進步有直接的關係。由於網際網路的進步，對於著作權的侵犯有了不同的風貌，除了直接使用著作所構成的侵權行為外，往往因為新工具的運用不當，或是非預期性目的的運用，網際網路服務業者（internet service provider，ISP）所提供的便利管道反而成為其被控訴負擔輔助侵權（contributory infringement）的主要證據。對於如何規範ISP的經營，各國政府也制訂了嚴格程度不同的規範，有著以法律加諸ISP對於其內容的責任，例如新加坡；亦有要求業者走向自律的行為，例如美國。在嚴格的規範下，可以有效防止各種網路上的犯罪行為；而從寬的規範，有助於各種營利與非營利行為在網際網路的創新與發展。如何平衡兩者的利害，皆為各國政府在制訂網路相關法規時所需要仔細思考的議題。本研究先由Sony公司推出錄影機而被控侵權的判例為前導，說明輔助侵權的意義，皆下來分析三件與著作權侵權有關的重要判例，到底ISP在何種情形下會在美國法院的主要見解下，負起輔助侵權的責任或免責，為本研究的主要目的。
