Title:	中國大陸國有企業用工制度改革之研究 The study of labour system reform in state enterprises in Mainland China

Abstract:	全文共分五章：第一章說明本論文的研究動機與目的，並敘述研究的基本觀點與方法。第二章從歷史的角度回溯中國大陸國有企業用工制度的形成與改革，第一節分別從國民經濟恢復時期、大躍進時期以及文革時期等不階段，說明國有企業用工制度的建立與形成過程，以及自十一屆三中全會後對於改革的阻延力量。第二節說明「勞動力商品化」爭議的思想淵源和爭論焦點。第三節舉出傳統文化與社會心理對於改革的制約性，而這些內在的力量往往是影響制度變遷的重大因素。第三章第一節在國有企業改革和勞動經濟學分析下，探討用工制度改革的經濟邏輯。並說明一九八六年後，國有企業用工制度改革的三個主要管道，分別以第二節敘述勞動合同制度的內容。第三節描述固定工制度改革的經濟基礎與做法。第四節說明企業富餘人員的處理與安置辦法。第四章探討用工制度改革所形成的新勞動關係以及其內含。第一節描述用工制度改革前後企業勞動關係主體與性質的變化。第二節說明建立契約化與法制化勞動關係的社會與經濟意義，並嘗試解析現行勞動合同制度。第五章為本文結論，從兩個面向來作出總結。第一節以總體的觀點來看待中國大陸所進行的「漸進式改革」的基本步調，並舉出用工制度改革所可能面臨的難題。第二節強調制度改革與所處社會的緊密結合關係，說明制度變革所引起的社會變遷，只要新場經濟改革的價值存在，這些變化將使中國大陸社會走向必須自我重建的關鍵時刻。
