Abstract:	多元價值併存，係自由、民主社會應有之現象。但內含道德原則之諸多價值間，往往無法通約共量，反之，尚會因相互歧異而對立衝突。為避免主流價值藉由機械式的民主多數決機制，堅決貫徹優勢多數之基本權利，形成犧牲、漠視或歧視非主流之弱勢價值，多元與寬容即須和諧共濟，併存共生。既允許價值紛雜併陳，即表示不嚴拒「價值相對」之理念，但與法之基本秩序與安定維繫間，難免會產生矛盾與衝突。針對此，咸信「基本權利」之多元保障，暫可作為「交疊性共識」（overlapping consensus）。我國憲法於第二章中列舉諸多基本權利，但隨時代演進，已不敷使用。透過司法院大法官釋憲，填補部分憲法未列舉權保障之闕失，特別是以憲法第二十二條之概括規定或基本國策中相關規定為依據。但釋憲屬司法權，有其被動性與侷限性，本書乃從學理論證並參酌釋憲實務，整理出生命、身體、尊嚴、人格、家庭、資訊、程序、集體、損失補償請求等憲法未列舉之自由與權利，對其憲法依據、保障範圍與限制，以及是否入憲等問題加以論述，期望能引起注意並討論。
