Abstract:	誰擁有資訊，誰就擁有權力。政府持有的資訊是屬於人民的公共財，因而政府資訊公開法制化的建立，是一個民主國家與開放社會必須積極努力的目標。同樣地，法治國家權力分立，行政依法而行，司法依法審查，各有其應遵循的界限，此亦為行政與司法各自運作應有的尊重與制衡。法治斌教授在本書開啟了資訊法制公開法制化的論述，同時，對於司法審查以個案解析方式，提供司法審查的輪廓。法教授後被提名為大法官，但在立法院行使同意權的前夕，因心肌梗塞辭世。本書對於建構資訊公開與司法審查做了最精采的論述，留給吾人繼續前進的榜樣。
