    Abstract: 美國法官 Learned Hand 曾經指出， 專利制度長期欠缺實證研究。今日高科技時代， 無論在創新模式，產業結構以及競爭環境上都顯著改變，專利法制上的變革，則顯得落後。電腦軟體專利保護的法制問題，充分暴露出這項法律上的窘態。本書從軟體專利問題發展的脈絡; 行政，立法，司法等法律制度面; 以及個案研究與統計分析等實證面，試圖將軟體專利法問題完整呈現，並予以批判; 最後提出未來改善之道的淺見。
