| Abstract: | 本研究計畫之第一部分論述團體協約制度之作為資本主義工業社會中,勞工集體與資方進行談判、協商的重要工具,以及此等制度在勞工運動史上、在勞動法制史上的崛起與其制度後續演變的主要軸線。 本計畫之第二部分則是將焦點集中拉回到我國。在此一部分中乃是論述我國團體協約制度的創建與發展。 計畫之第三部分乃是根據此一制度目前在國內之實際適用狀況,詳細分析我國團體協約制度功能不彰之主要癥結所在。同時論及近年來團體協約制度又再度受到重視,勞工行政主管機關基於政治、經濟考量已提出一部團體協約法修正草案。但其中有諸多規定是否果真曾經過充分論辯並兼顧各方利益,則頗值得懷疑,此等規定若果真賦之施行,恐怕將會衍生重大反彈而又陷入更大的困境。因此,本計畫將會針對該草案進行詳細的分析與評估。此外,去年由全國總工會與全國工業總會所進行之關於基本工資的團體協商,亦是締造我國勞動法史上之新猶。但此種全國性協商模式是否果真如某方所言值得推行或至少應默許之,並非無法律上之疑義,例如此兩造當事人是否為適格之當事人?是否具有團體協約的締約能力?而其協商權限之範圍又如何?到底就何等事項始有協商權限?此等全國性協商制度若果建立,不論短期或長期來看,究竟會對勞資雙方造成何等有利或不利的影響?凡此等等問題,在本計畫中均有所檢討。 本計畫之最後本於上述之分析,針對我國目前國情之特殊性,並在考量我國未來政經情勢的可能發展後,提出對現行制度之修正建議。 |
