    Abstract: 德國在 2002 年 7 月 1 日由聯邦下議會在第 14 立法會期通過了民法損害賠償法之修正案。德國新損害賠償法修正之原因，一方面是由於在過失責任、危險責任與慰撫金責任間為不同規範之合理依據為何並不明確，另一方面對於損害賠償法之內容，從立法到現今，已經產生了許多的變動，而法律條文已無法反應該變動。本次修正之內容主要為：一、以減輕舉證責任，及引進受害人對製藥之企業經營者及主管機關之詢問請求權，改善藥品責任；二、改善兒童在公路與軌道交通意外時之法律地位，原則上排除十歲以下兒童之與有過失，對於汽車駕駛人與軌道車輛之企業經營者，只有不可抗力才能免責；三、引進慰撫金之一般請求權，除了原先已經包括之非契約過失責任外，也擴及於危險責任及契約責任；除了故意責任 Vorsatzhaftung 外，對慰撫金請求權限於損害依其方法與期間非屬顯不重要者；四、對損害計算的變更；五、對汽車駕駛人責任擴及於無償乘載之人；六、提高及協調危險責任之責任上限；七、將金額改為歐元等。上述新法之修正，係針對於社會變動所為之修正，多半能反應最近的社會觀念及趨勢，對於我國之損害賠償法之重新思考亦多有助益。
