Abstract:	本研究旨在解明民法第193 條中有關「喪失或減少勞動能力」之損害賠償責任的本質，並以之檢討實務上採取抽像而不具個性之計算基礎的當否；同時，針對受害人之多樣化，並將立足於前述檢討結果，探究未成年人、家庭主婦、一時性失業者、打工者、精神或身體障礙者、外國人勞動者等因侵權行為而減損工作能力時，其與第193 條之關係。為達成上述目標，本研究將蒐集整理分析國內相關案例、並將其類型化，以掌握實務之具體判斷標準與考量要素。關於損害賠償性質之檢討，主要將參酌比較在學說實務上已累積相當成果之日本法的經驗，並較簡略地說明其他主要國家（德、美、英等）之現況，以收集思廣益之效。本研究之成果將有助充實損害賠償法之內涵，並期得供為實務於解決相關事案時之參考。
