    Abstract: 假設因果關係之存在的討論基本上是屬於刑法總則中犯罪理論的問題，這一 個問題事實上在德國刑法學界與實務運用都有不一樣的見解出現。而由於假設因 果關係在案例事實中，與一般常見之因果關係的出現有不一樣的判斷考量，使得 此一問題在評價結果之客觀歸責時也具備有重大的意義，然而在現有的文獻上假 設因果關係的存在，就犯罪判斷體系而言，是有爭議的。鑒於所謂因果關係預測 的不確定性，只有具備近乎確定可能或者極高的確定可能的結果發生之假設因果 關係的存在，才會被列入討論的範疇，也就是說，假設因果關係的考量與結果發 生的避免可能性是有緊密關聯的。在德國的刑法實務判例中，對於假設因果關係 的存在考量，曾有二個原則出現：（1）如果結果在合乎義務規範行為進行時，仍 然具有幾近確定的可能性會發生，則假設因果關係的存在可以影響行為與結果關 聯的判斷；（2）如果所謂幾近確定可能性的判斷有疑義時，應依照對行為人有利 的方向作解釋，該無罪推定的利益屬於行為人。 相對於德國刑法學界或實務的討論，我國刑法學界對於假設因果關係存在的 還可以有相當的思考空間，如將因果關係的判斷定義為本體論的事實檢驗，則在 應用結果歸責的概念時，假設因果關係的存在則成為歸責判斷的重要參數，如此 確實有必要對假設因果關係作全面的闡釋。
