    Title: 我國罷工合法要件之檢討

    Abstract: 本文乃係針對最高行政法院九十二年度判字第八一一號與台北高等行政法院九十年度訴字第一七九號判決所作之評釋。其中涉及的問題乃是在欠缺法律授權依據的情形下,執法機關另命違反水土保持義務人限期改正之行為是否合法?前揭行政法院裁判認為此舉已違反法律明確性原則,故為一違法之處分。然本文對此則持相反之見解,並認為前述判決不僅未能顧及行政實務及公益之需要,且論理基礎過於草率,因其一方面並未解析釐清限期改正之性質,以致誤解了限期改正與法律保留之間的關係;另一方面則是僅從單純的文義解釋角度去解釋法律,卻忽略體系論理解釋的重要性,因此未能發現系爭法條可能出現法律保留漏洞之情形,而失去了一次藉由法官造法填補漏洞之機會。
