    Abstract: 近年來,網路誹謗案例隨科技之發展而日益增多,實究因於人們基於網路的
    去中心化、匿名性、使用便利等特性而忽略於虛擬世界中所為之行為仍受真實世
    界之法律規範;其中,學生又為網際網路之高度使用者,且在個人主義思潮和言
    論自由高度開放的環境下,學生多有自主思想之表達,甚至是敢怒敢言,致使學
    生於網路發表之不當言論涉入社會糾紛甚至因而遭受訟累。針對此現況,本研究
    將搜尋國內外之案例進行分析,來歸納出網路不當言論之行為類型與成因後果,
    促使學生注意相關之法律規範,以期建立有效之規範對策。
    In the recent years, more and more libel cases have appeared as a result
    of the digital-technology development. Due to the features of decentralized
    architecture, anonymous identity, and convenience fostered by the Net, more
    and more people normally fail to aware that one has to be legally responsible
    for his or her behavior in the virtual world. The phenomenon is most common
    on campus because students are the most frequent users of the Internet. As
    the digital environment signifies freedom of speech and individualism,
    students usually tend to freely express their own thoughts and to be
    straight-forward to share their opinion. Nonetheless, this tendency has led
    to problems associated with students' posting inappropriate messages and
    resulting social disputes. Occasionally these disputes become endless
    litigations. This research analyzes domestic and foreign cases and
    categorizes typical behavioral types along with the causes and effects that
    would resulted in the problematic situation mentioned above. In conclusion,
    universities are advised to provide more legal education for students and
    establish an effective policy toward relevant issues.
