Title:	沒有方法的解釋只是一個政治決定─簡評司法院第六一三號解釋

Abstract:	第六一三號解釋的問題不在結論，而在達到結論的論證方法。大法官顯然已經認知主要爭點在於有任期保障的獨立機關，和責任政治、權力分立原則之間的衝突，以及政黨政治加入成為新的體制原則後，對前兩原則本身造成的影響，乃至處理此一衝突所生的微妙變化。解釋雖誠實面對了獨立機關這個國家治理的新興課題，但在NCC組織法的審查上，又前後明顯矛盾，且在理念上迥異於舊解釋，卻沒有作先例變更的闡明。方法的混亂再次暴露大法官處理政府體制議題在正當性和功能性上的瓶頸。完全看不到主要爭點的解釋文，則顯示解釋體例的恣意性。
