    Abstract: 團結權之保障為勞動三權之首，蓋無團結權，協商權與爭議權即無所從出。我國由於特殊歷史因素，造成對團結權內涵欠缺真正的了解，雖不至於如某些中南美國家對工會之領導者濫行逮捕拘禁，然保障亦尚非周全。國際勞工組織作為國際上經驗的大熔爐，國際勞工公約提供立法之基本準則，其所處理之眾多案例適可作為我國之殷鑑，而其匯集整理而成之原則，則可供立法之具體參考，並作為司法與行政解釋之最高指導原則。我國雖非國際勞工組織之會員國，但鑒於團結權之人權保障性質，及國際勞工公約與建議書之普世價值，對於勞動者團結權之保障應力求與國際同步，以盡到作為國際社會一員之責任。
