    Abstract: 一九四七年七月四日，國民政府頒佈〈厲行全國總動員戡平共匪叛亂訓令〉，國家進入動員戡亂時期；同年十二月二十五日，憲法開始施行，但是動員戡亂的情勢仍然存在。一九四八年四月十八日，第一屆國民大會第一次會議依據憲法第一百七十四條相關規定，制定〈動員戡亂時期臨時條款〉，賦予總統在動員戡亂時期的緊急處分權；五月十日，國民政府明令公佈，動員戡亂時期之憲政制度正式建立。〈動員戡亂時期臨時條款〉的制定，固然有著動員戡亂的時代背景因素存在，但是促使其實現的主要原因，應該與蔣中正在中國國民黨第六屆中央執行委員會臨時全體會議上，聲明拒絕參加行憲後第一任總統選舉一事，有著密切的關聯性。本研究之主旨，即在經由相關資料的研究分析，探討蔣中正拒絕參選第一任總統之原因，與中國國民黨黨內對於此事之反應；以及此事與國民大會制定〈動員戡亂時期臨時條款〉，建立動員戡亂時期制度之關係。
    On July 4, 1947 the Nationalist Government adopted" Plans for Mobilization against Communist Insurrection ", the country enter Period of mobilization for suppressing the Communist rebellion. On December 25 of the same year, the Constitution began to implement, but country still was confronted with the rebellion of the Communist Party and in a special situation. First Conference of the National Assembly was in April 18, 1948 to make interim clause for the Period of mobilization for suppressing the Communist rebellion. The interim clause gave the President right of disposing at time of emergency and carried out on May 10, 1948. Formulation of the interim clause for the Period of mobilization for suppressing the Communist rebellion, no doubt a background factor of the mobilizing and suppressing the rebellion exists, but impel its main reason made, declare to refuse to participate in the election of first President of post-Constitution with Chiang Kai-shek in the Provisional Plenum of the Sixth Kuomintang Central Executive Committee, there is close relation. The purpose of this research, through the analysis of the materials, it is explored why Chiang Kai-shek was unwilling to participate in the first presidential election, with the response of the Kuomintang members. And this thing and National Assembly to make interim clause for the Period of mobilization for suppressing the Communist Rebellion, establishes constitutional government systems of Period of mobilization for suppressing the Communist rebellion are related.
