    Abstract: 國內報導若違背專業義理而招物議，業者總是標榜新聞自由。立場不同者，往往各依利害解讀「新聞自由」，援為攻伐之資，致治絲益棼，使涉及媒體規範的重大公共辯論屢次失焦。即使對立各造不惜勞神費時興訟，也因理念各異而不能服於司法判決。癥結在新聞自由的若干核心問題一直未解，例如享此自由的主體為何、其內涵及界限為何、其拘束或對抗的對象或其「義務人」為何，甚至其規範的效力或正當性基礎何來等。 本計畫擬徹底整理英美文獻，憑經濟社會史觀點細究the press之起源及其演進過程，庶幾廓清上述問題；也擬正視日中與日台新聞學術思潮與術語之交通史，重驗國人是否誤譯曲解新聞自由概念。終究但願正本清源還原新聞自由的核心概念，並掌握新聞自由概念在不同憲政體制下的相對內涵及詮釋彈性，以供國內爭議攻錯。
