    Abstract: 我國為了因應數位科技匯流，不但通過通訊傳播基本法、國家通訊傳播委員會組織法，也於2006 年2 月成立了國家通訊傳播委員會(NCC)。NCC 於2007 年9 月對外公布其草擬的通訊傳播管理法草案（以下簡稱通傳法草案），以彙集各界意見。NCC 的通傳法草案在精神上有參考歐盟與英國的水平管制模式，但是提出的是基礎網路層、營運管理層及內容應用層的三層管理架構。由於NCC 鑑於通訊傳播基本法第十六條第一項的規定，認為要在成立兩年內修正通訊傳播法規，迫於時間壓力，NCC 在有限的時間內提出該版本，或許由於時間倉促及影響重大，引起各界不少疑慮，所以該草案已經兩度被行政院退回而暫時擱置。本研究計畫除了分析國外在其通訊傳播法規採用或不採用層級模式或水平管制架構的原因及作法，也針對NCC 送行政院之通訊傳播管理法草案版本作影響評估，最終目的是探討層級模式或水平管制架構納入我國通訊傳播法規架構的可行性，如果可行則該如何過渡與實踐？最後則針對我國「通訊傳播法」立法架構提出具體建議。本研究所採取的研究方法包括國內外相關文獻分析、比較法、深度訪談、親身觀察、法規影響評估與焦點團體座談。
    In order to cope with the technological convergence, the Fundamental Communications Act and the National Communications Commission (NCC) Organizational Act were passed in Taiwan. The NCC was established in February 2006. It drafted a convergent communications law in September 2007. Because of time restraints, the NCC did not have enough time to interact and negotiate with the relevant industries and the public interest groups. Therefore, the draft of the converged law was criticized and suspended. This research is aimed at studying the impact of the proposed converged law on the telecommunication and broadcasting industries and the public. It will study the reasons and practices of the adoption and non-adoption of layer model and horizontal regulations in other countries. It will also assess the feasibility of adopting the layer model or horizontal regulation in Taiwan’s converged communications law. Finally, it will conclude by proposing the framework for the converged communications law in Taiwan. Research methods include literature review, documentary analysis, in-depth interviews, personal observation, regulatory impact analysis, and focus group study.
