    Abstract: 教派化（Konfessionalisierung）理論，係德國歷史學者Wolfgang Reinhard 以及Heinz Schilling 兩位，於1981 年所共同提出的。這個理論所要處理的最重要議題，便是試圖從社會史的視野，來檢討歐洲在近代初期期間，當時的基督信仰、教會、帝國及其領邦乃至於整個社會，它們在歷經了來自於宗教改革所帶來的重大衝擊之後，究竟產生了何種互動與相互影響的作用。而正當世俗權力想要在此教派化的過程中，亦即積極地透過與特定基督教派進行策略性結盟，以藉此換取整合並經營現代國家所必須具備各種資源的時候，我們也看到了當時德意志境內的神聖羅馬帝國，因此陷入了分裂的危機。對於當時已經改奉新教的帝國領邦與帝國城市來說，他們不僅面臨來自以帝國皇帝為首的反宗教改革勢力在戰爭上的威脅，更必須承受來自帝國法學家所提出分離主義，以及特別是指稱他們破壞了對於帝國皇帝忠誠的嚴峻指責。為了有效回應此一責難，採取新教立場的帝國領邦，最終採取了一連串可以稱之為「法律化」（Verrechtlichung）的策略，亦即藉著提出一套新興的帝國公法論述，來解決當時由帝國方面在有關正當性與忠誠性等問題上所提出來的各種質疑。本研究計畫的最主要目的，便是想要從此一教派化理論所勾勒出來的特殊歷史脈絡中，循線鋪陳出十七世紀促成帝國公法形成的可能論述條件，並探討當時帝國公法相應論述的開展。
