Abstract:	本研究之主要目的，是試圖在我國憲法學中，發展一條新的人權論述途徑—平等公民權，並揭露我國憲法學的主流論述—普世人權與個人主義—的可能問題：第一，「人權」與「國家-社會」在這套論述中，是對立的緊張關係。第二，憲法研究者，鮮少觸及「公益」的價值，因而忽略了憲法促進國民全體利益的重要功能。第三，過於個人主義的人權論述，無法因應台灣（以及世界其他各國）有關追求新國族主義，國家認同等重要價值。第四，從倫理或哲學面而言，原子式的自由主義（atomic individualism）本來就不是，也不應該是憲法人權論述的唯一選項。第五，傳統的人權論述無法促進民主，甚至與民主政治產生緊張關係。它是一種以「免於侵害」為基礎的消極人權論。它無法建構積極參與公共事務的積極自由（positive liberty）相比之下，平等公民權是一個較能結合個人權利與社群價值，並且因應台灣主體意識的人權理論基礎。它在憲法上可以憲法第二條「主權屬於國民全體」做為文義基礎，並進而用以檢討批判台灣當前各種「排拒」與「貶抑」，並進而構成「次等公民」的法制措施。
