Abstract:	自由心證主義係民事證據法中關於法官認定事實之核心原則，其對於法官認定事實給予一定程度彈性空間，而得避免因僵化法定證據原則，造成具體個案上難以實現真實發現之訴訟法理想。但因此一原則有較為不明確之內涵，容易造成誤解，若操作不慎，其對於法治國原則所要求之法律安定性及法官依法裁判之原則，極易形成威脅，司法公信力經常因此而受到挑戰。我國學者對自由心證主義已有所注意，其研究成果甚值重視。本研究擬在國內既有研究成果之基礎下，引介德國、奧國及瑞士等國之法學者思想及其實務操作成果，並對於我國實務上判決及實務家之思考背景與方式，進行本土性實證研究及比對，用以尋得自由心證主義在我國被濫用或污名化之原因，並探求解決之途徑。
