    Abstract: 本研究擬結合相關之社會研究、跨國比較, 與憲法學理論, 建構出新移民憲法位階的「社會權」與「文化權」, 並作為進一步發展相關法制的法理基礎。此處所稱「社會權」, 主要包括: 工作權、社會給付請求權, 以及藉由反歧視法免於社會歧視的權利。而「文化權」則指少數族群保留、使用、發揚自身文化特色的權利, 諸如: 母語/ 雙語教育、族群觀點之學校教材、特殊語言節目或電台,乃至特殊族群習慣得免於一般法律之規範等。本研究擬探究並解決以下問題— 1. 憲法「工作權」與「生存權」規定, 是否/ 在何種程度內, 對新移民提供平等保障? 2. 新移民「文化權」之憲法基礎何在? 3. 在現實社會中, 我國新移民對「工作權」、「社會給付請求權」以及「文化權」的需求如何? 4. 若能證明我國憲法保障新移民的社會權及文化權,且新移民有此等需求, 當前的法令政策應做何等調整?
    This project would combine social studies, transnational comparison, and constitutional theories to develop the constitutional “social rights” and “cultural rights”for the newly-arrived immigrants in Taiwan. It would be also the theoretical ground to develop the relevant policies. The term “social rights” in this project includes: right to work, entitlement to social benefits, and right to be free from discrimination. The term “cultural rights”indicates minority ethnic groups’rights to reserve, exercise, and advance their own/ original cultural character. For instance, mother tongue/ bilingual language education, ethnic language program or broadcast station, the right to be exempted from generally applicable laws. The primary goal of this project is to explore and resolve the following questions: 1. Whether or to what extent the “Right to Work”and “Right to Life” provisions provide newly-arrived immigrants the equal protection? 2. What is the possible constitutional ground for newly-arrived immigrants’“cultural rights”? 3. Whether and to what extent the newly-arrived immigrants in Taiwan need the aforementioned rights? 4. How to adjust the current laws and policies to satisfy newly-arrived immigrants’social and cultural rights?
