Title:	建立完善勞資爭議處理機制之研究

Abstract:	（1）針對立法院甫通過之勞資爭議處理法修正草案（以下簡稱新法），以即將實施之新制度為據，提出我國未來勞動生活中，新興勞資爭議處理機制的理論觀察架構。（2）確立勞動生活法事實：分析我國原有勞資爭議處理機制（包括調解、仲裁、訴訟）之現況與困境，並嵌入新法的新興規範架構中，加以綜合考察。（3）就新法所建立之整套勞資爭議處理機制，包括調解、仲裁與裁決，以國內外理論暨實踐分析為據，提出適用上可能須注意之問題，試圖建立相關運行之模組。（4）分析現行勞動訴訟之制度性問題，並提出未來改革芻議或修法建議。
