Abstract:	在勞動基準法註釋之整合型計畫下，本子計畫之研究範圍與重點主要是有關基礎理論與附則的部分，共分三年逐步進行下列事項之研究：勞動法之概念與形成、勞動法基本思考與體系、勞動法法源、國際勞動法與法律衝突、勞動法之貫徹與執行、勞動基準法性質、勞工之概念、僱主之概念、事業單位之概念、勞動基準法適用對像、勞動基準法主管機關、勞動保護基本原則、勞動基準法之規範作用、勞動基準法之監督與檢查、勞動基準法罰則。 Under the integral research project 「Commentaryon Labor Standards Act(LSA)」, this subproject set its research point on the basic theory and general regulation. Within three years this project will step by step make its research focus on the following issues: concepts and arising of labor law, basic thinking and system of labor law, regulative fountain of labor law, international labor law and conflicts of laws, execution of labor law, essence of LSA, concepts of employer and employee, concepts of enterprise, objects for application of LSA, official resorts of LSA, basic principles of labor protection, normative function of LSA, supervision and examination of LSA, penalty provisions of LSA.
