    Abstract: 本件學術性專書寫作計畫,目的在研究刑事訴訟法強制辯護制度之學理及實踐。我國刑事訴訟法從立法之初,即引進歐陸刑事訴訟傳統之強制辯護制度。不過,在台灣實施超過六十年之強制辯護,具有辯護之名,卻常無辯護之實,實踐成果受到相當大之批評。晚近制定之法律扶助法,透過法扶律師之協助,強制辯護功能似乎漸漸有活化之跡象,不過,仍不盡理想。從刑事訴訟法制定之初到現在為止,強制辯護規定基本上並無重大修正或調整,只有於民國95年5月增定偵查中之強制辯護,將智能障礙無法完全陳述之被告,納入強制辯護保護範圍(刑事訴訟法第31條第5項)。國內對於強制辯護之學理與實踐,找不到有體系且較為基礎之學術性研究專書,本計畫意圖對此能有所補充。本學術性專書寫作計畫之大綱,大致如下:一、強制辯護之定義與功能二、強制辯護之學理基礎與刑事政策意義三、強制辯護之德國與我國法制史淵源四、德國關於強制辯護之具體規定五、歐洲人權法院關於強制辯護之判決六、我國強制辯護之具體規定七、強制辯護之證據禁止及其他違法效果八、強制辯護之救濟九、強制辯護之實證統計資料分析十、強制辯護之配套制度──法律扶助、律師費用十一、立法建議十二、結論由於申請人曾發表過一篇文章處理偵查中強制辯護議題,因而希望再以一年時間,擴充該文章內容,將強制辯護制度之學理與實務,以學術性專書方式完整呈現。
    This project aims to publish monograph which address the legal study of the theory and the practice of the compulsory defense in criminal justice. The compulsory defense is provided expressly in the rules of the Criminal Procedural Act of Taiwan, but in practice it is not with effort. On the contrary, the compulsory defense is also applied in the rules and practically successful in some other jurisdiction (Ex: Germany, USA, and Japan). With respect to those successful experiences in compulsory defense, this article will introduce and explain the effort in some other countries. This monograph starts to introduce the theory about compulsory defense in criminal justice, and then explain the rules of the Criminal Procedural Act of Germany and of European Convention on Human Rights, and also the rules of the Criminal Procedural Act of Taiwan. At last it will provide suggestions to the application of our provisions. The practice of Taiwan is another point in this monograph. We need to analyze our practice exactly so that it can demonstrate whether the provisions are functional. In particular, our compulsory defense is functional through the Legal Aid Foundation to assign the lawyer. However, there are discrepancies between the theory and the practice which had lead to different application of the rules. And the conclusion of this monograph is some legislative suggestions.
