    Abstract: 不當勞動行為實體法與程序法整合型計畫-不利益待遇與支配介入子計畫繼2008年修正公布團體協約法、2009年修正公布勞資爭議處理法後,在今(2010)年6月修正公布了工會法,長達十年以上的勞動三法修正工作終於完成預計於明(2011)年5月1日開始施行。現在正是我國集體勞動法制全新一頁的關鍵時刻。本次勞動三法修正中,其中最重要之一者,應為不當勞動行為制度。攸關我國未來集體勞資關係發展之不當勞動行為制度,係參考美國、日本、韓國之不當勞動行為制度所創設之制度,但對於我國而言,仍屬相當陌生之制度。在新法施行之後,除了條文之解釋以外,馬上會面對實際運作上的許多問題。因此,參考美國、日本、韓國之實際運作,研究不當勞動行為制度,實有燃眉之急。因此,本研究團隊提出本「不當勞動行為實體法與程序法整合型計畫」,希望能對於未來我國不當勞動行為之制度之理論探討與實務運作,有所助益。本研究「不當勞動行為實體法與程序法整合型計畫-不利益待遇與支配介入子計畫」乃上述計畫之一部分,主要是針對不當勞動行為制度之基礎理論及工會法修正條文第三五條第一項所規定的不當勞動行為類型-「不利益待遇」與「支配介入」進行美、日、韓三國與我國法制之比較分析研究。
    Unfair Labor Practice and Remedial System -The Study of Discrimination The three vital laws which mediate many aspects of the relationship between employers, employees and trade union had finally accomplished its amendment process. The Collective Bargaining Agreement Act was first amended in 2008, the Settlement of Labor Disputes Law in 2009 and Trade Union Law (Labor Union Law) in June, 2010. They will all be effective on May 1, 2011. This is the key turning point for the Collective Labour Law in Taiwan. “Unfair Labor Practices” is the most essential part of this amendment. It will have a great impact on the future of our industrial relations. Due to the reason that the system of “Unfair Labor Practices” in Taiwan is still very immature; we will observe the system in American, Japan, and Korea as the reference sources. In the near future, we will encounter numerous obstacles once the new law becomes effective, such as how to deliberate the explanation of the articles. Thus, it will be beneficial for us to study how American, Japan, and Korea actually operate the system of Unfair Labor Practices. Therefore, the study of Statutory Law and Procedural Law in Unfair Labor Practices would be a valuable source for studying theories and execute in practice in this field. The Study of Discrimination and Domination—the subproject of Statutory Law and Procedural Law in Unfair Labor Practices, will focused on theories of Unfair Labor Practices and the amendment of Article 35 I of Labor Union Act. Hence, the subproject “Discrimination” and “Domination” will do a comparison study in Taiwan, the U.S., Japan and Korea.
