    Abstract: 本文從現有法規基礎出發，以「臺北市資訊休閒服務業管理自治條例」為例，探討「網咖」服務業營業管制之問題。研究脈絡係以法律位階之概念開始，從抽象的憲法審查、到具體的法律規定精神，加以比較法之觀察，進一步探討該條例管制網咖業者營業之合適性。本文研究結論與見解為，由法律介入管制網咖業者可分為二個部分，即其一︰營業條件的管制（外在）；其二︰內容的管制（內在）。本文認為「臺北市資訊休閒服務業管理自治條例」雖立意良善，然對於網咖業者外在營業條件之管制，所衍生之問題恐怕大於所要解決的問題現狀；而對內容的管制亦顯窒礙難行，故建議修正條文內容或廢除。本文以為管理網咖較佳方式為，應充分掌握相關各方意見後（如︰消費者、網咖業者、主管單位），按此依據盡速通過中央版網咖條例，以解決目前各地方於法無據之現象與適用法律紊亂之問題。
