Title:	論著作權法中編輯著作對資料庫之保護範圍

Abstract:	資料庫所涉及之著作權法問題最近在國內法學界引起相當關注,由於相關案件中,資料庫之創作性或原創性常是爭議所在,因此,本文首先析述關於著作權法中對於編輯著作創作性或原創性之判斷標準,及其適用於資料庫保護時之相關考量。資料庫之建置本身其實是資料庫業者就既有資料所為之加值行為,而著作權法中編輯著作所保護之加值行為係指「就資料之選擇及編排具有創作性者」。然而,資料庫業者所為之資料加值行為種類繁多,究竟哪一部分係具創作性或原創性之資料選擇及編排行為,實不可一概而語,準此,本文亦針對目前實務上較具爭議之資料加值態樣,分析著作權法編輯著作之規範對於資料庫之保護範圍。
