    Abstract: 雲端運算技術近來已成為相關產業之關注焦點,甚至被稱為新一波的資訊科技典範移轉。包括軟體、硬體及各網路服務提供廠商均致力於投資雲端相關技術與服務。然而雲端運算之應用亦帶來一連串潛在的法律爭議。首先,就資訊安全與隱私權而言,由於使用者不再完全掌控資訊的儲存與運算,使得資訊外流的可能性大幅提升。雲端技術的穩定性則涉及雲端技術服務提供者與使用者間的風險分配。從通訊法的角度觀之,若由具市場力量的電信業者經營雲端業務,則易引發網路中立性之爭議。最後,於雲端運算環境中,亦可能產生軟體授權及網路服務提供者免責等著作權法相關討論。
